1. Terms and Conditions for Cashback Reward

1. This offer entitles the end user cashback on their Online Wallet or Bank Account or UPI. The customer will be responsible for their choice of the cashback transfer method.
2. By redeeming the Offer provided on the same, a participant agrees to be bound by the terms and conditions below (“Conditions”).
3. These Conditions apply to every person ("Participant”) redeeming the offer given by Premier Sales Promotions Pvt Ltd, No claim shall lie for any redemption requests made after the expiry of the Offer Period.

5. 6. All Participants agree that wallet partner offering discount vouchers may at any time stipulate additional terms and conditions for redemption of the discount vouchers and such terms and conditions shall be binding on the Participants and shall apply to every redemption of recharge/discount voucher by the Participants.
7. The Wallet Partner holds the right to refuse transactions deemed fraudulent as per their policies
8. In the event of any fraud detection, the wallet partner reserves the right to modify/change, discontinue, terminate, withdraw the Offer at any time during the Offer Period.
1. The Participant acknowledges that relevant state and central taxes may be deducted by the merchant while redeeming the discount offer and therefore, the amount reflected in the voucher may not be the same as the final redemption value received by the Participant.
10. In no event shall Premiere Sales Promotions Pvt Ltd or its partner agency be held liable for any issues relating to the redemption of the voucher including redemption request not being honoured by the wallet partner.
11. In no event shall the maximum liability exceed the value of the voucher as the case may be.
50. Any disputes or differences in connection with the offer shall be governed by laws of India and shall be subject to the exclusive jurisdiction of the Courts at Bengaluru.
1000. The wallet partner reserve the right to restrict cashback for any account with suspicious behaviour or invalid details/credentials. The wallet partner has the right to ask for documents to prove the customer/user identity

2. Contest Details, Concept and Participation:

1. These terms and conditions apply to the "Breezer Pop & Win" programme for consumers (hereinafter referred to as Contest") sponsored and launched by Bacardi India Pvt Ltd wherein consumers of BACARDI INDIA PVT LTD can participate by visiting the weblink
2. The contest is valid to all residents of India with the exception of the state of Tamil from 01/12/2021 to 31/03/2022 (herein after referred as "Contest Period").
3. During the Contest Period:

i. 117480 winners will be selected from Rest of India (excluding Tamil Nadu) who will win Cashback Vouchers

ii. 4 winners will be selected from Rest of India (excluding Tamil Nadu) who will win KTM Bike

iii. Assured Prize of 1 Month Online Music Subscription to all valid participants.

4. All IPR rights including trademark, copy right and designs used are the property of their respective owners.
5. The Contest is subject to all applicable central, state and local laws and regulations.
6. Consumers of BACARDI INDIA PVT LTD participating or seeking to participate in the Contest shall individually be referred to as "Participant" and collectively as "Participants".

2. People below 21 years shall be allowed to participate with their parents or guardians providing the necessary documentation on behalf of the minor. In such a case, the parent (s) or legal guardian of the minor may redeem the Prize at his / her own cost and shall execute the documents as required.
3. This website and any related content should not be accessed or viewed by you if you are not of legal drinking age in your country, province or territory. You confirm that you are legal drinking age and that you are not in a country, province or territory where the consumption of alcoholic beverages or the content of this website is not permitted. 5. BACARDI INDIA PVT LTD or its Agency will not be responsible for any NDNC (National Do Not Call) Registry regulation that will come into play. All Participants who participate will agree as per the terms and conditions that even if they are registered under NDNC, DND (Do Not Disturb), BACARDI INDIA PVT LTD or its Agency will have all the authority to call such shortlisted winners by virtue of them having voluntarily participated in the Contest.

6. Contest Period & Contest Timings:

1. The contest will commence from 12.00:01 AM on 01/12/2021 to 11:59:59 PM on 01/03/2022
2. Time of participation will be defined as the time at which the entry is received through the SMS mode of participation at BACARDI INDIA PVT LTD computer.
3. Entries coming outside the Contest Period will not be considered for winner selection.
4. The contest shall run on all SKUs of Bacardi India Pvt Ltd
5. Packs without the promo also available in the market.

7. Prizes:

1. During the Contest Period, 117,484 winners will be selected for Prizes for contest period of 90 days. Therefore, there will be a total of 117,484 such prizes which will be declared during the contest period.

8. How to Participate:

1. Any participant can enter any number of times during the contest period from a mobile number.
2. Step 1: Customer to give a missed call on 7406609333 to receive a weblink
3. Step 2: Customer to visit the weblink and enter their name, mobile number and unique code (you can find the unique code under the crown of your Bacardi Breezer). Please follow the steps as described on the weblink to confirm your participation.
4. BACARDI INDIA PVT LTD and the Partner Agency shall not be responsible for (including but not limited to):

i. For any SPAM generated messages

ii. For the Operator Code not being displayed on the user's mobile phones

iii. For any SMS message delivery failures

iv. Any lost, late or misdirected computer transmission or network, electronic failures or any kind of any failure to receive entries owing to transmission failures or due to any technical reason

v. If the participant has registered himself to the DND of the telecom provider/ the participant has registered with National Do Not Call Registry/

vi. Participant has specifically requested for not receiving messages for the specific campaign

vii. Other conditions beyond its reasonable control

viii. Any SMS not deliverable due to changes in TRAI policies / Telcom operator policy.

9. Winner Selection:

1. Any participant can win a max of 1 lucky draw prize during the contest period from a mobile number. However, participants can claim a maximum of 3 assured rewards vouchers during the contest period.
2. From the Valid Entries received, the Organizer will select 4 winners for Bike content, 117,480 winners for cashback who will win Prizes throughout the Promotion Period (“Winners”)
3. Winners will be selected by the Organizers using randomizer software irrespective of the time of the entry.
4. Prizes will be given subject to the winner satisfying the verification process of BACARDI INDIA PVT LTD
5. The Prize cannot be transferred, exchanged or redeemed for cash. In the event that the winner does not take the prize in the time and manner stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize. Prizes must be taken as offered and cannot be varied. Any unclaimed prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken in exchange for cash.

7. BACARDI INDIA PVT LTD shall provide the prize on an "as-is basis" and without any warranty or guarantee concerning the quality, suitability or comfort, and BACARDI INDIA PVT LTD and/or its associates, affiliates and/ or its management, directors, officers, agents, representatives shall not be responsible for or liable (including but not limited to the product and service liabilities) for deficiency and/ or defect of any product/service and/or the prize or for any kind of consequential damages/ loss, in any manner whatsoever. If any Participant has any grievance with respect to the prize, he/she may directly contact the manufacturer.
8. The image of the prize depicted on the press ads/posters/TVC's/pack shots etc. are for illustrative purposes only and the actual prize may vary from the depiction made.
1. BACARDI INDIA PVT LTD or its Agencies shall not be liable for any loss or damage of the prize due to Act of God, Governmental action, Force Majeure circumstances and / or any other reasons which are beyond the reasonable control of BACARDI INDIA PVT LTD / its Agency, and under no circumstances, BACARDI INDIA PVT LTD shall be liable to pay any compensation whatsoever for such losses.
10. Any participant of the contest who wins any one of the prize during the Contest Period shall not be eligible to win any further prizes.
11. The winner generation for Prizes will be done on the basis of Valid Unique Number + Unique mobile number

10. Contacting Winners:

1. Once the Winners are selected, the Partner Agency appointed by BACARDI INDIA PVT LTD shall process the gift for the winner.
2. For Assured Reward & Cashback Reward: The participants of the contest for assured reward and winners for the cashback reward will receive a reward code and a weblink to claim their respective rewards.
3. For KTM Bike Winners, Partner Agency shall contact the winning on their winning mobile winner. In the event the shortlisted winner's number is busy, unreachable, or he/she does not attend the call, two (2) more attempts will be made to reach the Participant on that day and/or the next day. If even on the third attempt, the Participant does not attend the call, or is unreachable, the Participant's participation in the contest comes to an end and the Participant's entry stands cancelled and Participant becomes ineligible to receive the prize.
4. In the event the shortlisted winner attends the call on either the second or third attempt, the procedure outlined in step (s) shall apply.
5. If any shortlisted winner remains unreachable on the third attempt or is not interested in continuing in the Contest or is otherwise ineligible to participate, the Agency shall conduct up to two (2) more random selections to shortlist a Participant. If even after a third random selection, no winner is selected, no prize shall be declared in respect of the contest.
6. In case of a positive response from the shortlisted winner (for KTM Bike), each such shortlisted winner will be required to send the following documents and collateral:

i. Copy of Address proof (Electricity bill or Mobile Bill) from the city as mentioned in their participation SMS

ii. Copy of Aadhar Card & PAN Card & Driving Licence is mandatory for gifts above Rs. 10,000

iii. Gift Tax by way of DD or Cheque in favour of Premier Sales Promotions Private Limited of 31.2% if the value of the gift is above Rs. 10,000

iv. Original Crown with winning code will be required to claim the prize.

7. This will be referred to as Participation Package for the winner. The completed Participation Package needs to be sent to BACARDI INDIA PVT LTD or it’s partner agency within 48 hours of the call made by Agency to the selected winner.
8. Upon receipt of the Participation Package, BACARDI INDIA PVT LTD or its Partner Agency shall scrutinize all documents. If all the documents and the wrapper submitted are in order and valid then be treated as a Confirmed Winner.
1. No prize will be awarded if the information presented by the Participant(s) at the time of entering the contest is not factually correct.
10. The cost and expenses of postage shall be borne by the participant himself. BACARDI INDIA PVT LTD or the Partner Agency shall not be responsible for any accident or mishap or loss of the Participation Package by the participant in transit.
11. The responsibility of ensuring that the Participation Package reaches the address as directed by BACARDI INDIA PVT LTD or its Partner Agency lies solely with the participants.
50. No justification/explanation for non-receipt of the Participation Package or any missing documents shall be accepted.
1000. In the event of death of the Confirmed Winner, no claim from the nominee or his/her legal heirs of the Confirmed Winner shall be entertained for receiving the prize.

11. Publicity:

1. The Participant/s undertake and irrevocably and unconditionally permit BACARDI INDIA PVT LTD to cover the Contest through various media including newspapers, radio television news channels, internet, point of sale materials, etc., and shall not raise any objection, protest or demur to such coverage or in this regard.
2. The winners must, at the request of BACARDI INDIA PVT LTD, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to BACARDI INDIA PVT LTD using their name and image in promotional material.

12. Intellectual Property:

1. All right, title and interest, including but not limited to the Intellectual Property Rights, in the promotional material(s) and in any and all responses received shall vest solely and exclusively with BACARDI INDIA PVT LTD at all times. BACARDI INDIA PVT LTD or any person or entity permitted by BACARDI INDIA PVT LTD in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future promotional, marketing, publicity and any other purpose, without any permission and or payment to the Participant.
2. All material submitted in connection with the Contest (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to BACARDI INDIA PVT LTD upon submission and become the property of BACARDI INDIA PVT LTD exclusively. BACARDI INDIA PVT LTD may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of

13. General Terms & Conditions of the contest:

1. Each Participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. By taking part and/or entering into the Contest the Participant warrants that all information provided by Participant regarding Participant's name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.
2. The decision of BACARDI INDIA PVT LTD or its Agency, as regards the selection of winners and distribution of the prizes shall be final, subject only to BACARDI INDIA PVT LTD 's approval. No correspondence or any other claims whatsoever, in this regard will be entertained.
3. No queries, claims, dispute, complaints or grievances shall be entertained by BACARDI INDIA PVT LTD and its agency after 30 days from the date of the closure of the contest.
4. A participant can win a maximum of 1 prize during the contest period. If a participant has won any one of the prize, then that participant will not be eligible to win any further prizes.
5. All applicable taxes will be borne by the winner.
6. Wherever Gift Tax is applicable, the amount will be Bourne by the customer.
7. The prize cannot be exchanged and is not transferable and cannot be converted into cash.
8. BACARDI INDIA PVT LTD reserves the right to change, defer, alter or cancel this Contest in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Any decision of BACARDI INDIA PVT LTD in this regard and in general with respect to this Contest and the terms and conditions thereto shall be final, binding and conclusive.
10. Nothing contained herein amounts to a commitment or representation by BACARDI INDIA PVT LTD to conduct further Contests.
11. The decision of BACARDI INDIA PVT LTD shall be final in all regards and no communication shall be entertained in this regard. None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or agency between any Participant and BACARDI INDIA PVT LTD and the Participant shall not have the authority to bind BACARDI INDIA PVT LTD in any manner whatsoever.
50. BACARDI INDIA PVT LTD or any of its respective officers/employees/directors shall not be responsible for delayed, lost, mutilated, corrupted or illegible documents etc.

BACARDI INDIA PVT LTD or its Agency shall not be liable to perform any of its/their respective obligations under the Contest or in respect of the prize where it is unable to do so as a result of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, or any other Force Majeure condition, etc., and shall not be liable to compensate the Participant in these circumstances.
14. BACARDI INDIA PVT LTD or it’s agency shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Contest due to any government restrictions.
15. Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of BACARDI INDIA PVT LTD or its Agency.
16. BACARDI INDIA PVT LTD or its agency accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, loss of SMS, loss of internet connectivity, unique codes, documents, demand drafts, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. BACARDI INDIA PVT LTD or it’s agency shall not be liable for any consequences of user error including (without limitation) costs incurred.
17. If a Participant is dissatisfied with the Contest or the Contest rules and/or any content or any requirements of the Contest form, the materials available related thereto, or with these terms and conditions, his/her sole and exclusive remedy is to not participate in the Contest.
18. If a person chooses to access the Contest Website from outside India, he/she shall do so on his/her own initiative and shall be responsible for compliance with applicable local laws of the country.
19. The operational part of the scheme like delivery of gift shall be managed by the BACARDI INDIA PVT LTD or it’s partner agency; However, the promotional product will be distributed through BACARDI INDIA PVT LTD Distributor/dealer.
20. The participation in the Contest is purely voluntary and the same shall be construed as an acceptance of the terms and conditions stipulated herein.
21. Validity of Prize cannot be extended, OR new Prize cannot be provided against the expired/unused Vouchers.
5. All disputes arising out of or in connection to this scheme are subject to exclusive jurisdiction of the courts in Bangalore only.

14. TERMS & CONDITIONS for BIKE

1. It is clarified that:

i. “Bike” shall mean and imply a KTM Bike: Duke 125 base model, at the “ex showroom” Price.

ii. “Price” shall mean the “Ex Showroom price”.

iii. Registration Charges, Road Tax, Insurance Charges and Gift Tax will be bourne by the winner. Any other form of taxes if applicable will be borne by the winner.

2. BACARDI INDIA PVT LTD reserves the right to reallocate the prize to another participant.
3. The prizes are personal to the winners and are not transferrable and cannot be sold under any circumstances. Prizes cannot be exchanged for cash or kind. No request for change in make, model, color, and specifications etc of the bike will be entertained.
4. All the participants shall be required to ensure that the mobile number(s), e-mail address and/or other details provided by them to BACARDI INDIA PVT LTD via the website or otherwise are true, accurate and in use. Any liability, consequence or claim arising on account of any incorrect or outdated information provided by the participants to BACARDI INDIA PVT LTD shall solely be borne by the affected/concerned participants.
5. BACARDI INDIA PVT LTD shall at no time be required to verify the accuracy and/or correctness of the information so provided by the participants. Further, you are responsible for maintaining the confidentiality of your mobile phones, e-mail accounts and passwords.
6. BACARDI INDIA PVT LTD or its partner agency accepts no responsibility for any tax implications that may arise from the prize winnings. Tax is to be borne by the winner. Winners will have to bear incidental costs, if any, that may arise for redemption of the Prizes.
7. The delivery time will vary depending on the availability of the Bike. On receipt of complete Winners information and completion of all formalities, the approximate delivery time will be communicated to the confirmed winners. Goods once delivered cannot be replaced under any circumstances.
8. Premier Sales Promotions Pvt. Ltd. will offer product warranty in case it is offered by manufacturer/distributor and all claims towards warranty need to be taken up with the manufacturer/distributor directly.
1. In case the Bike is not available in the winner city, Premier Sales Promotions Pvt. Ltd. will arrange the availability of the bike nearest to the city (where dealership of the bike is available). All costs associated towards travelling/accommodation or any other cost which might incur will be borne by the winner.
10. There is no cash alternative for the Prize and the same cannot be exchanged for cash at any point nor transferred to someone else.
11. Acceptance of Prize constitutes permission to BACARDI INDIA PVT LTD to

meeting of the participants? requirements or aspirations, timeliness, security, un- interestedness, error-free, the results or reliability of the promotion, or the delivery, quality, quantity, merchantability, fitness for use or non-infringement in respect of any goods, services, emoluments, benefits or awards acquired or obtained through the promotion.
